Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the ClaimPod website, the demo environment, and any related services (together, the “Service”). By requesting access to, or using, the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you confirm that you are authorized to bind that organization, and “you” refers to that organization. If you do not agree, do not use the Service.

The Service is provided by UAB “Baium Software”, a private limited liability company registered in the Republic of Lithuania (company code - 307672466), with its registered office at Avižų g. 1-25, LT-08435 Vilnius, Lithuania (“we”, “us”, or “ClaimPod”). You can reach us at hello@claimpod.dev.

ClaimPod is offered as an early-access product. Features may change, be added, or be removed, and the demo environment is provided for evaluation only. It may contain sample or placeholder data and should not be used for real patient records, live claims, or production billing.

We do not guarantee that the Service will be uninterrupted, available at any particular time, or free of errors, and we may suspend or discontinue all or part of it at any time.

You must be at least 18 years old and able to enter into a binding contract to use the Service. If we issue you demo credentials, you are responsible for keeping them confidential and for all activity that happens under them. Tell us promptly at hello@claimpod.dev if you believe your credentials have been compromised.

You agree not to:

• use the Service in violation of any applicable law or regulation;
• upload real protected health information (PHI) or other sensitive personal data into the demo environment;
• attempt to gain unauthorized access to, probe, or disrupt the Service or its underlying systems;
• reverse engineer, copy, resell, or create derivative works from the Service except as permitted by law; or
• submit content that is unlawful, infringing, or that you have no right to share.

Personal data you provide through this site is handled as described in our Privacy Policy. ClaimPod is built for HIPAA compliance and audit-grade security; however, the early-access demo is not intended for live PHI, and any production processing of health data will be governed by a separate written agreement (including a data processing agreement and, where applicable, a business associate agreement).

Any non-public information we share with you about the Service is confidential, and you agree not to disclose it without our consent.

The Service, including its software, design, text, and the ClaimPod name and logo, is owned by UAB “Baium Software” or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for evaluation purposes, subject to these Terms. All rights not expressly granted are reserved. Any feedback you give us may be used without restriction or obligation to you.

Access to the early-access demo is currently provided free of charge. Any paid plans, and their pricing and payment terms, will be presented to you and agreed separately before they apply.

To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will meet your requirements or produce any particular billing, reimbursement, or financial result.

To the fullest extent permitted by law, UAB “Baium Software” will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud. Where mandatory consumer-protection rights under EU or Lithuanian law apply to you, those rights are not affected by these Terms.

You agree to indemnify and hold harmless UAB “Baium Software” from any claims, damages, or expenses (including reasonable legal fees) arising from your misuse of the Service or your breach of these Terms, to the extent permitted by applicable law.

These Terms apply while you use the Service. We may suspend or terminate your access at any time, including if you breach these Terms or if we discontinue the early-access program. You may stop using the Service at any time. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability, and governing law) will continue to apply.

These Terms are governed by the laws of the Republic of Lithuania, without regard to its conflict-of-laws rules. Disputes will be subject to the jurisdiction of the competent courts of Lithuania. If you are a consumer resident in the EU, you keep the protection of the mandatory provisions of the law of your country of residence, and you may also use the European Commission's online dispute resolution platform.

We may update these Terms from time to time. When we do, we will revise the date below and, for material changes, take reasonable steps to notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.
